Governing use of the SK Mankilam Digital Platform

1. Acceptance of Terms

By accessing and using the SK Mankilam Digital Platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

These Terms constitute a legally binding agreement between you and the Sangguniang Kabataan of Barangay Mankilam, Tagum City, Davao del Norte.

2. Definitions

For the purposes of these Terms of Service, the following definitions apply:

"Platform" refers to the SK Mankilam Digital Platform, including all web pages, mobile applications, and related services.

"SK Mankilam" or "We" refers to the Sangguniang Kabataan of Barangay Mankilam, Tagum City, Davao del Norte.

"User" or "You" refers to any individual who accesses or uses the Platform.

"KK Member" refers to a registered member of the Katipunan ng Kabataan in accordance with DILG MC 033-2022.

"Personal Data" refers to any information from which the identity of an individual can be reasonably and directly ascertained, or when put together with other information would directly and certainly identify an individual, as defined under RA 10173.

"DPO" refers to the Data Protection Officer appointed by SK Mankilam to oversee data privacy compliance.

"Services" refers to all features and functionalities provided through the Platform, including but not limited to KK registration, equipment borrowing, and scholarship management.

3. Service Description

The SK Mankilam Digital Platform provides online access to youth services, including:

  • - Katipunan ng Kabataan (KK) member registration in compliance with DILG MC 033-2022
  • - Equipment borrowing requests and management
  • - Scholarship applications and service hour tracking
  • - Event announcements and community engagement
  • - SMS notifications for registered members (with consent)

These services are provided exclusively for residents of Barangay Mankilam aged 15 to 30 years old.

4. User Responsibilities

As a user of this platform, you agree to:

  • - Provide accurate and complete information during registration
  • - Maintain the confidentiality of your account credentials
  • - Use the platform only for legitimate purposes
  • - Comply with all applicable laws and regulations
  • - Report any unauthorized access or security breaches immediately
  • - Return borrowed equipment in the same condition as received
  • - Provide valid identification when required for verification

You are responsible for all activities that occur under your account.

5. Intellectual Property Rights

Platform Ownership

The SK Mankilam Digital Platform, including its design, content, features, and functionality, is owned by the Sangguniang Kabataan of Barangay Mankilam. All rights are reserved.

User License

You are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes related to SK services.

User Content

You retain ownership of personal information and documents you submit. By submitting content, you grant SK Mankilam the right to use such information for the purposes stated in our Privacy Notice.

Prohibited Uses

You may not copy, modify, distribute, sell, or lease any part of the platform. Reverse engineering, decompiling, or attempting to extract source code is prohibited. Commercial use of platform content without authorization is not permitted.

6. Limitation of Liability

Service Provided "As Is"

The SK Mankilam Digital Platform is provided on an "as is" and "as available" basis. While we strive to maintain reliable services, we do not warrant that the platform will be uninterrupted, error-free, or completely secure.

No Guarantee of Availability

We do not guarantee continuous availability of the platform or any specific feature. Services may be temporarily unavailable due to maintenance, updates, or technical issues.

Limitation of Damages

To the maximum extent permitted by applicable law, SK Mankilam shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

Force Majeure

SK Mankilam shall not be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to natural disasters (typhoons, earthquakes, floods), government actions, power outages, internet service disruptions, or public health emergencies.

7. Indemnification

You agree to indemnify, defend, and hold harmless SK Mankilam, its officials, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

  • - Your use or misuse of the Platform
  • - Your violation of these Terms of Service
  • - Your violation of any applicable laws or regulations
  • - False, inaccurate, or misleading information you provide
  • - Damage to borrowed equipment beyond normal wear and tear
  • - Any claim by a third party arising from your actions on the Platform

This indemnification obligation shall survive the termination of your account and these Terms of Service.

8. Dispute Resolution

In the event of any dispute, claim, or controversy arising from or relating to these Terms or your use of the platform, the following resolution process shall apply:

  1. Direct Contact: Contact SK officials directly (SK Chairman or SK Secretary) at the Barangay Mankilam Hall or via sk.mankilam@skmankilamgov.ph
  2. Barangay Mediation: If unresolved, disputes may be referred to the Lupong Tagapamayapa (Barangay Justice System) for mediation
  3. Data Privacy Matters: For privacy-related concerns, contact the Data Protection Officer at dpo.mankilam@skmankilamgov.ph
  4. NPC Complaints: For data privacy violations, you may file a complaint with the National Privacy Commission as detailed in our Privacy Notice
  5. Legal Action: As a last resort, disputes shall be subject to the exclusive jurisdiction of the courts of Tagum City, Davao del Norte

9. Termination and Account Suspension

Voluntary Termination

You may request deletion of your account at any time by contacting the Data Protection Officer. Account deletion will be processed in accordance with our data retention policy.

Grounds for Suspension

SK Mankilam may suspend or terminate your account for:

  • - Providing false or misleading information
  • - Violation of these Terms of Service
  • - Misuse of borrowed equipment or services
  • - Fraudulent activity or abuse of the platform
  • - Extended inactivity (accounts may be archived after 5 years of inactivity)

Notice and Appeal

Except in cases of serious violations requiring immediate action, you will receive reasonable notice before account termination. You may appeal termination decisions by contacting the Data Protection Officer within 30 days.

Effect of Termination

Upon termination, your access to the platform will be revoked. Personal data will be handled according to the retention policy in our Privacy Notice. Certain data may be retained as required by law (e.g., DILG reporting requirements, audit trails).

10. Third-Party Links

The Platform may contain links to third-party websites, applications, or services that are not owned or controlled by SK Mankilam. These include but are not limited to:

  • - National Privacy Commission (NPC) website for data privacy complaints and resources
  • - Department of the Interior and Local Government (DILG) resources
  • - Tagum City Government official portals
  • - Payment processing services (if applicable)

SK Mankilam has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any third-party. You acknowledge and agree that SK Mankilam shall not be responsible or liable for any damage or loss caused by your use of or reliance on any third-party content, goods, or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines, including but not limited to:

  • Republic Act 10173 - Data Privacy Act of 2012
  • DILG Memorandum Circular No. 033-2022 - Guidelines on the Conduct of the Katipunan ng Kabataan Registration
  • NPC Circular 2023-06 - Security of Personal Data in Government Agencies
  • Civil Code of the Philippines - General provisions on contracts and obligations

Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the appropriate courts in Tagum City, Davao del Norte, Philippines.

12. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent, or if modification is not possible, it shall be severed from these Terms.

13. Amendment Procedure

SK Mankilam reserves the right to modify, update, or revise these Terms of Service at any time to reflect changes in our services, legal requirements, or operational needs.

Notification of Changes

For material changes that significantly affect your rights or obligations, we will provide at least 30 days advance notice through:

  • - Prominent notice on the platform
  • - Email notification to registered users (if email is provided)
  • - SMS notification (for users who have consented)

Your continued use of the platform after the effective date of any changes constitutes acceptance of the modified Terms. If you do not agree with the changes, you should discontinue use of the platform and may request account deletion.

14. Data Protection

We are committed to protecting your personal information in accordance with the Data Privacy Act of 2012 (RA 10173), DILG MC 033-2022, and other applicable privacy laws.
